Bail Granted: Court Releases Accused in Kidnapping and Ransom Case.


In Vijay Vijay Kumar v/s State (Govt. Of NCT Of Delhi) an accused person, arrested in connection with FIR No. 30/2021 at Darya Ganj Police Station, has been granted regular bail. The charges against the individual include offenses under Sections 377 (unnatural offenses), 419 (cheating by personation), 364A (kidnapping for ransom), 34 (acts done by several persons in furtherance of common intention), and 120B (criminal conspiracy) of the Indian Penal Code, as well as the Arms Act.

 

 

The prosecution's case alleges that on February 1, 2021, the husband of a complainant was abducted by four people who demanded a ransom. The initial demand of Rs. 5,00,000 was negotiated down to Rs. 50,000. Through a police operation involving technical surveillance and a decoy carrying the ransom money, the victim was rescued and the accused individuals, including the applicant, were arrested. An Aadhar card and the victim's purse were recovered from the applicant.

The court, however, noted that a co-accused, Swapnil, who was deemed to have a more significant role in the crime, had been granted bail on the same day. The court found the applicant's role to be "much lighter" in comparison. The judge referenced the detailed order granting bail to the co-accused and concluded that the same relief should be extended to the applicant.
Considering these circumstances, the court allowed the bail application. The accused will be released upon furnishing a personal bond of Rs. 10,000 with one surety of the same amount.
